When is a DWI a felony?

If most DWI offenses are considered misdemeanors, when, precisely, do they become more serious? According to Texas law, there are four different circumstances in which a DWI offense can be considered a felony offense.

The following DWI charges are considered felonies in Texas:

  • Third-time DWI felony. If you have been convicted of your third DWI offense, it will be considered a third-degree felony.
