What are the penalties for a 2nd or 3rd DWI?

The severity of penalties depends on the nature of the offense. Because this is not your first DWI and you have a past record, you can expect that the penalties will be harsher. The courts will also consider your age – if you’re a minor, you’ll be charged with an underage DUI.

A conviction for a subsequent DWI offense can result in the following penalties:

  • Second DWI: Up to 1 year in jail, $4,000 in fines, and up to 2 years license suspension
  • Third DWI: A third DWI is considered a felony DWI in the state of Texas. 2-10 years in Texas Department of Criminal Justice, $10,000 in fines, and up to 2 years license suspension
