Penalties for Identity Theft

As with most theft crimes, the severity of your penalties depend on the circumstances of your offense. Typically, identity theft crimes are charged as either a state jail felony, third-degree felony, second degree felony, or first-degree felony. Penalties can include incarceration, fines, probation, and restitution.

The number of identification items found at the time of your arrest will impact the penalties. If convicted, penalties can include:

  • Less than 5 identification items: Up to 2 years in state jail and fines up to $10,000
  • More than 5, but less than 10 identification items: Up to 10 years in state prison and $10,000 in fines
  • More then 10, but less than 50 identification items: up to 20 years in state prison and $10,000 in fines
